Acceptable Use Policy

This Acceptable Use Policy (“AUP”) is part of the Terms of Service (the “Agreement”). If you use the Services, you must follow this AUP. If this AUP and the Agreement conflict on acceptable use or enforcement, this AUP controls on those points. Defined terms in the Agreement apply here.

The list below is not exhaustive. We decide, in our reasonable commercial judgment, whether conduct violates this AUP. You are responsible for your users, customers, resellers, and anyone you allow onto the account.

We have no duty to monitor content or traffic. We may inspect, log, throttle, filter, or remove material when we reasonably believe this AUP, the Agreement, or the law requires it, or when needed to protect the platform or other customers.

1. Prohibited content and activity

You may not use the Services to store, publish, transmit, distribute, or facilitate:

  1. Conduct that is illegal under U.S. federal law or under the law that applies to you.
  2. Child sexual abuse material, or any sexual content involving minors. We will remove it and may report it.
  3. Malware, ransomware, phishing kits or phishing pages, credential-theft tools, botnet command-and-control, exploit kits, or material whose primary purpose is unauthorized access to systems.
  4. Fraud, identity theft, stolen credentials, carding, or impersonation of a person or brand in order to deceive.
  5. Content you do not have the right to host, including copyrighted material you know is unlicensed. A complaint is not required for us to act.
  6. Unlawful harassment, credible threats of violence, or publication of another private person’s sensitive personal data for the purpose of harming them.
  7. Unsolicited bulk email or other unsolicited commercial messages, including mail that violates CAN-SPAM or similar law. Honor unsubscribe requests for mail you send through the Services.
  8. Open proxies, open relays, anonymizing exits, or traffic-forwarding services run to hide abuse.
  9. Cryptocurrency mining or similar high-load compute on shared infrastructure, unless we approve a separate arrangement in writing.
  10. Scanning, flooding, attacking, or attempting to break into third-party systems or our systems without written authorization from the owner.
  11. Content or mail that gets our IP space or domains listed on a blocklist, or that causes an upstream provider to demand removal.
  12. Any use that bypasses plan limits, isolation, or billing.

Legal adult content that does not involve minors and is otherwise lawful is not banned by this section, but it remains subject to resource limits, the rest of this AUP, and the law.

2. Resource, security, and resale

Do not bypass usage limits, isolation, or security controls.

Do not share credentials in a way that lets someone unauthorized into the account. You are responsible for all activity under the account, including activity after a compromise, until you tell us and we confirm we have cut off that access.

Keep software you install reasonably current. We may suspend an account that is infecting others or our network, even if you did not intend it.

Do not resell shared hosting, or run unmanaged multi-tenant sites for third parties, without our written approval.

We may cap CPU, RAM, storage, inodes, processes, mail volume, bandwidth, or connections when use harms the platform or other customers. Plan words such as “unlimited” do not override this section.

3. Email

If you send mail through the Services, you must follow the From-domain, DNS, and volume practices we publish or require. You must have consent or another lawful basis for marketing mail.

Do not send mail that produces blocklist damage to our space. We may disable outbound mail immediately if that happens.

4. Enforcement

We may investigate. We may remove content, null-route traffic, reset credentials, disable mail, suspend, or terminate, with or without prior notice, when we reasonably believe delay would cause harm, when law or an upstream provider requires action, or when the breach is serious.

For a first, limited, non-security issue, we may give the account email a chance to fix it. We do not have to.

We may report activity to law enforcement or to an injured third party and may keep logs.

Repeated or serious violations, including repeat copyright infringement, may end the account and future service.

If we suspend or terminate for an AUP violation, prepaid fees are not refunded. You will pay our reasonable out-of-pocket costs caused by the violation, including blocklist remediation, vendor incident fees, and restoration work we choose to do.

Our logs and ticket records are presumptive evidence of what the account did.

5. Copyright notices

To report alleged copyright infringement on the Services, send a notice through the Legal department at Submit a Legal notice, and also send a copy to:

The notice must include: (a) the copyrighted work; (b) the location of the material (URL or path); (c) your name, address, phone, and email; (d) a statement that you have a good-faith belief the use is not authorized by the owner, its agent, or the law; (e) a statement under penalty of perjury that the information is accurate and that you are the owner or authorized to act; and (f) your physical or electronic signature.

We may remove or disable access when we receive a complete notice. If you are the account holder and you believe the material was removed by mistake, open a Legal ticket with a counter-notice that identifies the material, states under penalty of perjury that you have a good-faith belief it was removed by mistake, consents to jurisdiction in Atlanta, Georgia, and includes your signature. We may restore the material after 10 business days unless the complainant files an action.

We may terminate accounts that are repeat infringers.

This section is a notice procedure. It does not, by itself, mean we have filed a designated-agent registration.

6. Changes

We may update this AUP. Material changes will be posted at https://getsimple.net/acceptable-use-policy/ and, when the Agreement requires it, noticed by email or in the client area. Use after the effective date is acceptance. If you do not agree, cancel under the Agreement before that date.
